Welcome to Truffe & Co! The terms "we", "our" and "us" refer to Truffe & Co. Truffe & Co operates this store and website, including all information, content, features, tools, products and related services, in order to offer you, as a customer, a personalised shopping experience (the "Services"). Truffe & Co uses the Shopify platform, which enables us to provide you with the Services.

The general terms below, together with the policies referenced within them (the "Terms of Use" or "ToU"), describe your rights and responsibilities when you use the Services.

We have made every effort to present our products faithfully in our online store. Please note, however, that the colours or appearance of products may differ from what is displayed on your screen due to the type of device you are using, as well as its settings and configuration.

All product descriptions are subject to change at any time, without notice, at our sole discretion. We reserve the right to withdraw a product from sale at any time and may limit the quantities offered to any person or geographic region, on a case-by-case basis.

ARTICLE 3 - ORDERS

When you place an order, you are making an offer to purchase. Truffe & Co reserves the right to accept or refuse your order at its discretion. Your order is only considered accepted after written confirmation from Truffe & Co. We must receive and process your payment before your order is validated. Please check your order carefully before submitting it. If your order is refused, modified or cancelled, we will attempt to contact you using the email address, billing address and/or phone number provided at the time of the order.

Your purchases are subject to our Return and Refund Policy, as well as to the right of withdrawal applicable to customers in the European Union (France, Belgium and other EU countries).

ARTICLE 4 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged will be the one in force at the time of the order and stated in the confirmation email. Our prices are displayed in Swiss francs (CHF) or euros (EUR) depending on your delivery country, including any applicable taxes. For orders delivered outside Switzerland (in particular to France and Belgium), customs duties, import VAT or handling fees may apply and remain payable by the recipient, in accordance with local regulations.

You agree to provide current, complete and accurate purchase and payment information for all purchases. You represent and warrant that: (i) your payment method details are accurate, (ii) you are authorised to use it for the purchase, and (iii) you will pay the charges incurred at the prices displayed, including shipping costs and all applicable taxes.

ARTICLE 5 - SHIPPING AND DELIVERY

All delivery times indicated are estimates and are not guaranteed. We accept no liability for delays caused by carriers, customs formalities or any event beyond our control. As soon as the products are handed over to the carrier, the risk of loss transfers to you, subject to mandatory provisions protecting consumers in the European Union.

ARTICLE 6 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, text, images, graphics, reviews, videos and content, as well as their design and arrangement, are the exclusive property of Truffe & Co or its licensors. They are protected by Swiss, French, Belgian and international intellectual property laws.

These Terms authorise you to use the Services solely for personal, non-commercial purposes. You are not permitted to reproduce, distribute, modify, create derivative works from, republish or transmit any material present on the Services without our prior written consent. All rights not expressly granted are reserved by Truffe & Co.

The names, logos, product names, designs and slogans of Truffe & Co are protected and may not be used without our prior written authorisation.

ARTICLE 7 - OPTIONAL TOOLS

You may use tools provided by third parties, which we do not control. We provide access to these tools "as is" and "as available", without warranty of any kind. Use of these tools is entirely at your own risk. It is your responsibility to be aware of and accept the terms set by the relevant third-party providers.

ARTICLE 8 - THIRD-PARTY LINKS

The Services may contain links to websites operated by third parties. We are not responsible for the content or accuracy of these sites. If you choose to access them, you do so at your own risk. Complaints regarding third-party products and services must be addressed directly to the third party concerned.

ARTICLE 9 - RELATIONSHIP WITH SHOPIFY

Truffe & Co is powered by Shopify, which enables us to offer you the Services. Any sale or purchase made in our store is carried out directly with Truffe & Co. By using the Services, you acknowledge that Shopify is not responsible for any aspect of the sales between you and Truffe & Co. You release Shopify and its subsidiaries from any claim arising from your purchase and your transaction with Truffe & Co.

ARTICLE 10 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, available on our site. As the Services are hosted by Shopify, certain information may also be processed by Shopify in order to provide and improve the Services. By using the Services, you acknowledge that you have read these policies.

ARTICLE 11 - FEEDBACK

If you submit ideas, suggestions, reviews or other content to us ("Feedback"), you grant us a worldwide, non-exclusive and royalty-free licence to use, reproduce, modify and display it for any purpose, including commercial purposes. Consumers in the European Union (in particular in France and Belgium) benefit from the legal guarantee of conformity and the guarantee against hidden defects provided for by law. These legal guarantees apply independently of these terms.

Subject to these mandatory legal rights, and unless expressly stated otherwise by Truffe & Co, the Services and all products offered are provided "as is" and "as available". We do not warrant that your use of the Services will be uninterrupted, timely, secure or error-free.

ARTICLE 16 - LIMITATION OF LIABILITY

To the maximum extent permitted by law, Truffe & Co, Shopify and their partners shall not be held liable for any indirect, incidental or consequential damage, loss or harm, including loss of profits, data or revenue, arising from your use of the Services or of any product obtained through the Services. Nothing herein limits liability that cannot be excluded under applicable law, in particular towards EU consumers.

ARTICLE 17 - INDEMNIFICATION

You agree to indemnify and hold harmless Truffe & Co and Shopify, as well as their partners and staff, against any third-party claim arising from (1) your breach of these Terms, (2) your violation of a law or of the rights of a third party, or (3) your use of the Services.

ARTICLE 18 - SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, it will remain applicable to the maximum extent permitted by law, and the unenforceable part will be severed from these Terms without affecting the remaining provisions.

ARTICLE 19 - ENTIRE AGREEMENT

Failure to exercise a right provided for in these Terms does not constitute a waiver of that right. These Terms constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreement.

ARTICLE 20 - ASSIGNMENT

You may not assign this agreement or your rights without our prior written consent. We may assign these Terms and our rights and obligations without your consent.

ARTICLE 21 - GOVERNING LAW AND DISPUTES

These Terms of Use are governed by Swiss law. Any dispute will be submitted to the jurisdiction of the courts of the Canton of Vaud (Switzerland), subject to mandatory provisions protecting consumers in their country of residence (in particular in France and Belgium), who retain the right to bring proceedings before the courts of their domicile.

ARTICLE 22 - DISPUTE RESOLUTION (EU CUSTOMERS)

Before taking any action, we invite you to contact us directly at contact@truffeco.com: we always look for an amicable solution.

If no agreement is reached, consumers residing in the European Union may contact the European Consumer Centre in their country, which provides free assistance with cross-border disputes.

ARTICLE 23 - CHANGES TO THE TERMS

You can consult the most recent version of the Terms of Service at any time on this page. We reserve the right to update or modify any part of these Terms by publishing the changes on our site. Your continued use of the Services after publication constitutes acceptance of the changes.
